Titled and Buildable Land in Marrakech: How to Check Before You Buy

Land is the purchase where legal checks matter most, and also where a good deal can be hidden among bad ones. "Titled and buildable" are the two words you want to see, and both must be proven by documents, not by the seller's word.

What "titled" means

A titled plot (titre foncier) is registered at the land registry with a unique number, boundaries and a named owner. The title is the strongest proof of ownership in Moroccan law. Ask for a recent certificate of the title from the registry, not an old photocopy.

If the plot is not titled

Some plots are sold on the basis of an ownership deed (moulkia or adoul deed) and are not yet registered. They can be registered, but the process takes time and can reveal disputes. Price should reflect the risk, and a lawyer should be involved. A beginner should prefer titled land.

What "buildable" means

Building rights depend on the planning zone. Ask the planning office for the information note for that plot: the zone, the maximum height, the share of the plot that can be built, and any road or utility planned across it. A plot can be titled and still not be buildable.

Red flags

  • The seller refuses to give the title number.
  • The price is far below the neighbours, with no explanation.
  • Several people claim to own the plot or a part of it.
  • No legal access to the road.
  • The land is agricultural. See can a foreigner buy land.

Practical checks

  1. Visit with the title in hand and compare boundaries.
  2. Check water, electricity and road access, and the cost to connect them.
  3. Ask the notary to review the file and prepare the deed.
  4. Budget the fees, see notary and registration fees.

Frequently asked questions

How long does it take to register an untitled plot?

It can take months or longer and sometimes reveals disputes. Do not count on a quick outcome.

Can a bank finance a plot?

Banks often prefer to finance a plot together with a construction project, and they want clean title. Ask early.

Who checks the planning rules?

The planning office gives the information note, and your architect or builder interprets it. Ask for both before you pay a deposit.
